Terms of Service

Effective Date: September 28, 2026

1. Who we are and acceptance of these terms

The Genesis Fit ("The Genesis Fit," "we," "us," or "our") is a gym and personal training studio at 1899 Ocean St, Marshfield, MA 02050. These Terms of Service apply when you use our website (https://www.thegenesis.fit), contact us or interact with us on Instagram, Facebook, text message, or email, or use our services. By doing any of these, you agree to these terms. If you don't agree, please don't use the website or our channels.

2. Bookings, cancellations, and memberships

Class and appointment bookings, cancellations, memberships, packages, and freezes are managed through Mindbody. They are governed by the liability waiver, membership agreement, and policies you accept in Mindbody (including cancellation windows, late-cancel and no-show fees, and renewal terms). If anything in these terms conflicts with an agreement you signed in Mindbody, the signed agreement controls for that topic.

3. Health disclaimer and assumption of risk

  • Exercise, strength training, and conditioning carry a risk of injury. By taking part in any class, session, or program, you accept those risks as described in the waiver you signed.

  • Talk to your doctor before starting or changing an exercise program, especially if you have a medical condition, injury, or are pregnant.

  • Tell your coach about any injuries or limitations, and stop exercising and get help if you feel pain, dizziness, or shortness of breath.

  • Information from our coaches, website, social media posts, and messages (including automated or AI-assisted replies) is general fitness and wellness information. It is not medical advice and does not replace care from a licensed healthcare professional.

4. Messaging (Instagram, Facebook, text, and email)

  • You can reach us by Instagram direct message or comment, Facebook Messenger or comment, text message, and email. We use these channels to answer questions, help with bookings, and share updates.

  • Some replies may be automated or AI-assisted so we can respond quickly, including outside business hours. The Genesis Fit team oversees these tools. Automated replies can make mistakes. Pricing, schedules, and membership terms confirmed in Mindbody or by a staff member take priority.

  • You can ask for a human at any time. Type "human" or "talk to a person." If no one can reply right away, we'll ask for your email address and follow up by email.

  • Text messages: message frequency varies and message and data rates may apply. Reply STOP to stop texts (this stops texts only) and HELP for help. Emails: use the unsubscribe link to stop marketing emails (this stops emails only).

  • Please don't send sensitive medical details, payment card numbers, or passwords through social media messages.

  • How we handle your messages is explained in the Privacy Policy.

5. Payments

Payments for memberships, classes, and packages are processed through Mindbody, and through Stripe where applicable (for example some invoices or online purchases). Prices, billing schedules, and refund rules are those shown at purchase or in your Mindbody agreement. You authorize us and our payment processors to charge your chosen payment method for the purchases and recurring memberships you sign up for.

6. Intellectual property

Everything on our website and social channels (our name, logo, photos, videos, workouts, programs, and written content) belongs to The Genesis Fit or its licensors. You may view and share our posts for personal, non-commercial use. You may not copy, sell, or republish our content or programs without our written permission.

7. Acceptable use

Please don't misuse our website or channels. That includes posting unlawful, abusive, or harassing content, spamming, impersonating others, or trying to disrupt or gain unauthorized access to our systems. We may hide or remove comments, and block accounts, that break these rules.

8. Limitation of liability

To the fullest extent permitted by law:

  • the website, our content, and our messaging channels are provided "as is," without warranties of any kind, and

  • The Genesis Fit is not liable for indirect, incidental, special, or consequential damages arising from your use of the website or messaging channels.

Our total liability for any claim relating to the website or messaging channels is limited to the amount you paid us in the 12 months before the claim. Liability for in-person training and facility use is governed by the waiver and agreements you signed in Mindbody. Nothing in these terms limits liability that cannot be limited under Massachusetts law.

9. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Massachusetts, unless your signed agreement says otherwise.

10. Changes to these terms

We may update these terms from time to time. We'll post the new version on this page and update the effective date. If you keep using our website, channels, or services after a change, you accept the updated terms.

Privacy Policy

Effective Date: September 28, 2026 (replaces the privacy policy dated December 19, 2019)

1. Introduction

Welcome to The Genesis Fit ("The Genesis Fit," "we," "us," or "our"). Your privacy matters to us. This Privacy Policy explains what personal information we collect, why we collect it, how we use and share it, how long we keep it, and the choices you have. It covers:

  • our website (https://www.thegenesis.fit),

  • our gym and coaching services in Marshfield, Massachusetts,

  • class booking and client records,

  • our emails and text messages, and

  • your messages and comments to us on Instagram and Facebook (including Facebook Messenger).

By using our website or services, or by contacting us on any of these channels, you acknowledge this Privacy Policy.

2. Information We Collect

Information you give us

  • Contact and account details: your name, email address, phone number, mailing address, date of birth, and emergency contact.

  • Membership and booking details: memberships, packages, class and appointment bookings, attendance and check-ins, and signed waivers or agreements.

  • Health and fitness information: fitness level, goals, injuries, limitations, and other health details you choose to share so we can coach you safely. This information is sensitive, so please share only what you're comfortable with.

  • Payment information: billing name, billing address, and payment method details. Card numbers are processed by our payment processors (mainly Mindbody, and also Stripe) (see Section 5). We do not store full card numbers on our own systems.

  • Messages and communications: what you send us by email, text message, phone, website forms, Instagram, or Facebook Messenger, and our replies.

Information from Instagram and Facebook (Meta) When you message or comment on our Instagram account (@thegenesisfit) or our Facebook Page (The Genesis Fit), Meta Platforms, Inc. provides us with:

  • the content of your message or comment (text, and any photos, videos, or links you send),

  • your public profile name or username, and your profile picture where available,

  • an ID that Meta assigns to identify you to our business, and

  • the time of the message or comment, and which post it relates to.

We receive only what Meta makes available to businesses through its official platform. We do not receive your Facebook or Instagram password, and we do not have access to your private messages with anyone else.

Information collected automatically

  • Usage data: your IP address, browser and device type, pages visited, and the date and time of your visit.

  • Cookies and similar technologies: our website (hosted on Squarespace) uses cookies to run the site, remember your preferences, and understand how the site is used. You can control cookies through your browser settings.

3. How We Use Your Information

We use your information to:

  • provide, manage, and personalize our training, classes, and memberships,

  • handle bookings, check-ins, waivers, and client records,

  • process payments, invoices, and refunds, and keep our accounting records,

  • answer your questions and messages on every channel, including Instagram and Facebook,

  • send service messages (booking confirmations, reminders, schedule changes, and account and billing notices),

  • send marketing messages (promotions, events, and news), only where you've agreed to receive them or where the law otherwise allows,

  • coach you safely based on the health and fitness information you share,

  • improve our services, website, and communications, and

  • protect the security of our systems, prevent fraud, and meet our legal obligations.

4. Instagram and Facebook Messages and Comments

When you contact us through Instagram direct messages, Instagram comments, Facebook Messenger, or Facebook comments, we receive and reply to them through Meta's official business tools and APIs.

  • Why we use it: to answer questions about classes, pricing, scheduling, and memberships, and to help you book or get started.

  • AI-assisted and automated replies: Some replies may be drafted or sent with the help of AI tools or automation, so you get a quick answer, including outside business hours. The Genesis Fit team oversees these tools and reviews conversations.

  • Reaching a human: You can ask for a person at any time by typing "human" or "talk to a person" in the conversation. If no one can reply right away, we'll ask for your email address and a member of our team will follow up with you by email. You can also email chris@thegenesis.fit or call us at (339) 793-8087.

  • What we don't do: We don't sell your Instagram or Facebook information. We don't use it to build advertising profiles, and we don't share it with data brokers. We use it only to talk with you and to provide our services.

  • Public comments: Comments on our posts are public on Instagram and Facebook. We may reply publicly and, where Meta allows, privately.

  • Meta's own policies: Meta's handling of your information is covered by Meta's own Privacy Policy (https://www.facebook.com/privacy/policy/) and Instagram's terms.

  • Deleting this information: See Section 10, "How to Request Data Deletion," and the Data Deletion section below.

5. Service Providers We Use and What They Do

We use trusted service providers to run our business. They process your information only for the purposes described here, and only under their own privacy and security obligations.

  • Mindbody (booking, client records, waivers, and payments): We use Mindbody to manage class and appointment bookings, memberships, check-ins, client profiles, signed waivers, and membership and class payments. When you book, sign a waiver, pay, or create an account, your information is stored in Mindbody and is also subject to Mindbody's privacy policy.

  • Meta (Instagram and Facebook): for receiving and replying to your messages and comments (see Section 4).

  • Google Workspace: We use Google Workspace (for example Gmail, Google Calendar, and Google Drive) for business email, scheduling, and storing business documents. These may contain your messages or client-related records.

  • Stripe (payments): Stripe processes some card and other online payments for us (for example invoices or online purchases not handled in Mindbody). Stripe receives your payment details directly and handles them under its own security standards (including PCI-DSS).

  • QuickBooks (Intuit) (accounting and invoicing): We use QuickBooks for invoices, payment records, and bookkeeping. QuickBooks may store your name, contact details, and transaction history.

  • Email and SMS delivery providers: used to send the emails and text messages described in Section 6.

  • Customer relationship management (CRM) and marketing tools: We use, or may start using, a CRM or marketing platform to organize contact details, track inquiries and conversations, schedule follow-ups, and send the emails and texts described in Section 6. Any such provider is used only on our behalf and under confidentiality and security obligations.

  • AI tools: used to help draft or send replies and to organize our communications (see Section 4). We do not allow these providers to sell your information.

  • Website hosting (Squarespace): hosts our website and its forms.

6. Email and Text Message (SMS) Communications

Types of messages

  • Service messages: booking confirmations, class reminders, schedule changes, and account or billing notices.

  • Marketing messages: promotions, events, offers, and news. We send these only if you've opted in or where the law otherwise allows.

Text messages (SMS)

  • By giving us your mobile number and agreeing to receive texts, you consent to receive text messages from The Genesis Fit at that number. Some may be sent using automated technology. Consent is not a condition of purchase.

  • Message frequency varies. Message and data rates may apply.

  • Reply STOP to any text to stop receiving text messages. Replying STOP stops texts only. It does not unsubscribe you from emails and does not affect Instagram or Facebook conversations.

  • Reply HELP for help, or contact us using the details in Section 14.

  • We do not sell or share your mobile number or text-message consent with third parties or affiliates for their own marketing.

Email

  • To stop marketing emails, click "unsubscribe" in any marketing email. Unsubscribing from email stops marketing emails only. It does not stop text messages; to stop texts, reply STOP to a text.

  • Even after you unsubscribe from marketing, we may still send service emails or texts related to your membership, bookings, or payments.

Instagram and Facebook

  • To stop messages from us on Instagram or Facebook Messenger, tell us in the conversation or block or mute us in the app. Doing so does not change your email or text preferences.

You can also change any of your communication preferences by emailing chris@thegenesis.fit.

7. How We Share Your Information

We do not sell your personal information. We do not rent it or trade it either. We share it only:

  • With service providers listed in Section 5, to run our business on our behalf.

  • For legal reasons: when required by law, subpoena, or valid request from public authorities, or to protect the rights, safety, and property of our members, staff, or others.

  • Business transfers: in connection with a merger, sale of company assets, financing, or acquisition of all or part of our business, in which case this policy continues to apply to your information.

  • With your permission: in any other case where you ask us to or agree to it.

8. How Long We Keep Your Information

  • Messages and inquiries (Instagram, Facebook, email, text, and website forms) from people who don't become clients: kept for up to 12 months after our last contact, then deleted.

  • Client and membership records (Mindbody profile, bookings, waivers, and health and fitness notes): kept while you're an active client and for up to 12 months after your membership ends, unless we need them longer for a legal reason.

  • Payment and accounting records: kept as long as tax and accounting laws require.

  • Marketing preferences and opt-outs: kept so that we keep honoring your choices.

When information is no longer needed, we delete it or make it anonymous.

9. Your Rights and Choices

Depending on where you live, you may have the right to:

  • Access: ask what personal information we hold about you and get a copy.

  • Correction: ask us to fix inaccurate or incomplete information.

  • Deletion: ask us to delete your information (see Section 10), subject to certain legal exceptions.

  • Opt out of marketing: by email, by text, or both (see Section 6).

  • Withdraw consent: where we rely on your consent.

To use any of these rights, email chris@thegenesis.fit. We may need to verify your identity before acting on a request. We will respond within 30 days, and we won't treat you differently for using your rights.

Massachusetts residents: We follow Massachusetts data-protection requirements, including the state's standards for protecting personal information (201 CMR 17.00) and its data breach notification law (M.G.L. c. 93H). If a security breach affects your personal information, we will notify you and the appropriate authorities as the law requires. Massachusetts residents may use all the rights listed above, and may also contact the Massachusetts Attorney General's Office with privacy concerns.

10. How to Request Data Deletion

You can ask us to delete the personal information we hold about you, including information we received through Instagram or Facebook. You can do this in either of two ways:

  1. Email chris@thegenesis.fit with the subject line "Data Deletion Request." Include your name and the email address, phone number, or Instagram or Facebook name you used with us.

  2. See the Data Deletion section of this page.

We will confirm we got your request, verify it's you, and complete the deletion within 30 days. We'll let you know when it's done. We may keep limited information where the law requires it (for example payment records for tax purposes) or to record that you asked us not to contact you.

Deleting information from our systems does not delete your messages from Instagram or Facebook themselves. You can delete those in the apps, and Meta controls them under its own policies.

11. Data Security

We use reasonable administrative, technical, and physical safeguards to protect your personal information. These include access controls, secure (encrypted) connections, reputable service providers, and limiting access to staff who need it. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

12. Children's Privacy

Our website, messaging channels, and online services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 online. If we learn that we have received personal information from a child under 13 without verified parental consent, we will delete it. If you believe a child under 13 has given us information, contact chris@thegenesis.fit.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, services, or legal requirements. When we do, we'll post the new version on this page and update the effective date. If the changes are significant, we'll take reasonable steps to let you know.

Data Deletion

The Genesis Fit, Marshfield, MA

You can ask us to delete the personal information we hold about you at any time. This includes information from our website, bookings, emails, texts, and messages or comments you sent us on Instagram or Facebook Messenger.

How to request deletion

Email chris@thegenesis.fit with the subject line "Data Deletion Request" and include:

  • your full name,

  • the email address and/or phone number you used with us, and

  • your Instagram username or Facebook name, if you contacted us there.

What happens next

  1. We confirm we received your request.

  2. We may ask a simple question to verify it's really you.

  3. We delete your information from our systems and our service providers' systems within 30 days, and let you know when it's done.

We may keep limited records where the law requires it (for example payment records for tax purposes), or a note that you asked us not to contact you, so we keep honoring that choice.

Messages on Instagram and Facebook

Deleting your data from our systems does not remove messages stored by Instagram or Facebook. You can delete conversations in the Instagram or Facebook app. Meta manages that data under its own privacy policy.

Just want fewer messages?

  • Texts: reply STOP to any text. This stops texts only.

  • Emails: click unsubscribe in any marketing email. This stops marketing emails only.
